1. ABOUT VISIONARY PEOPLE MENTORING, THE OWNER OF THE WEB SITE

1.1. The Website is owned by the Visionary People Mentoring company of Drs. Thierry Limpens.

Visionary People Mentoring is a mentoring service that arose from the idea that no one can stop someone’s visionary power. Or rather, people’s belief in their visionary power cannot be stopped. Visionary power shows the positive life force of people who are unstoppable in creating sustainable success.

The mentor program guides success and success potential of people, companies and organizations through the concept of what it calls visionary power. Visionary People Mentoring’s mission is to help people express this power creatively/artistically.

The program begins by inventorying the visionary power of the client, or ‘mentee’ (the one being guided), in terms of their skills, life highlights, visions, talents and capabilities. This inventory is established by means of in-depth interviews and observations.

The next step is to work with the customer (mentee) to develop how this inventory can be externalized. Here, the program explores which partners can be hired to translate a presentation of the mentee’s visionary power into, for example, an autobiography, a film, a poem, a visual work of art, or in another artistic expression. Visionary People Mentoring, together with the customer, determines which resources are appropriate for creatively/artistically propagating her or his visionary strength.

1.2. In terms of business operations, Visionary People Mentoring is cooperative. It concludes contracts with clients who are administratively managed and supervised by the Belgian sections of the Smart group.

Smart is an international cooperative that was founded in Belgium in 1998. The cooperative assists thousands of autonomous workers in the development of their activities in a wide variety of sectors. Smart is present in almost 40 cities in 8 European countries.

The Smart group is based on various legal structures. Smart is managed in Belgium and France as a single subgroup, with four separate boards of directors managing the different entities: for Belgium the Smart Foundation (SmartBe) and SmartCoop, for France the Scic SmartFr and the Scop GrandsEnsemble. An annual general meeting is organized, in which all structures are integrated.

The Belgian Smart-Coop is registered under the legal structure of “cooperative company with limited liability with a social purpose” (CVBA SO, in Dutch). The company operates in the spirit of the International Cooperative Alliance (ICA). This is the umbrella world organization of the international cooperative movement.

2. AGREEMENT FOR WEBSITE TERMS AND CONDITIONS

2.1. These Terms and Conditions constitute a legally binding agreement between you, whether personally or in the capacity of an entity (“you”) and Visionary People Mentoring (“we”, “us” or “our”), regarding your access and use of the www.visionarypeople.net Website as well as any other form of media, media channel, mobile Website or mobile application associated with, linked to, or otherwise associated with it (collectively expressed: the Site). You agree that by accessing and using the Site you have read, understood and subscribed to all of the Terms and Conditions. If you do not agree to all of the Terms and Conditions, you are expressly prohibited from using the Site and must stop using it immediately.

2.2. Additional Terms and Conditions or documents that may be posted to the Site from time to time are expressly incorporated herein by reference. We reserve the right, at our sole discretion, to make changes and modifications to these Terms and Conditions at any time for any reason.

2.3. We will alert you to any changes by updating the “last update” date of these Terms and Conditions. You waive any right to receive a specific note regarding such change.

2.4. It is your responsibility to check these Terms and Conditions periodically to stay informed of the updates. You will be the subject of and will be deemed to be aware of and have accepted any changed Terms and Conditions as a result of your continued use of the Site after the date on which the revised Terms and Conditions are posted.

2.5. The information provided on the Site is not intended to be distributed or used by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or be the subject of any other what obligation to register within such district or country.

2.6. Accordingly, persons who choose to access and use the Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

2.7. Persons under the age of 13 and persons who do not have the full legal capacity are not permitted to use the Site. The Site is intended as a source of information for Users who are at least 13 years of age. All persons who are minors (usually under the age of 18) and persons who do not have the full legal capacity in the jurisdiction where they reside are not permitted to use the Site's commercial and other applications (web forms, submissions, payments) . Visionary People Mentoring does not give them permission to provide data.

2.8. If you are a minor, your parent or guardian must have read and approved the Terms and Conditions as well as the Privacy Policy before using the Site.

3. USER STATEMENTS

3.1. By using the Site, you represent and warrant:

  1. that any information you provide will be genuine, accurate, up-to-date and complete;

  2. that you will ensure the accuracy of such information and immediately update the registration if necessary;

  3. that you have the legal capacity and that you agree to comply with these Terms and Conditions; that you are not under the age of 13 if you wish to read the information presented on the Site;

  4. that in case you want to use the applications on the Site (web forms, registrations, commercial products), you are not a minor in the jurisdiction where you reside, or, if you are (a minor), you have then been given parental consent to use the Site;

  5. that you will not consult and use the Site by access by automated or non-human means, be it by way of a robot, a script or otherwise;

  6. that you will not use the site for any illegal or unauthorized purpose; that your use of the Site will not violate any applicable law or regulation.

3.2. If you provide information that is untrue, inaccurate, out of date, or incomplete, we reserve the right to interrupt or terminate our contractual relationship with you, if any, and all current and future use of the Site (or any part of it).

4 PROHIBITED ACTIVITIES

4.1. You may not consult or use the Site for any purpose that is outside the purpose for which we make the Site available. The Site may not be used in connection with commercial endeavors unless expressly supported and approved by us.

4.2. As a User of the Site you agree:

  1. that you do not systematically extract data and other content from the Site without our written permission to create or compile, directly or indirectly, a collection, compilation, database, or manual;

  2. that you will not make unauthorized use of the Site, including User’s Usernames and / or email addresses by electronic or other means for the purpose of sending requested emails or creating User accounts by automated means or under false circumstances ;

  3. that you do not use a sales agent or a buying agent to make purchases on the Site;

  4. that you will not use the Site to advertise or make offers to sell goods and / or services;

  5. that you do not bypass, disable or interfere with security-related features, including features that prevent or restrict the use or copying of any content or that enforce restrictions on the use of the Site and / or its content;

  6. that you do not engage in any unauthorized forming of or linking to the Site;

  7. that you do not cunningly approach, deceive or mislead us and other Users, especially in an attempt to obtain sensitive information such as User passwords;

  8. not to make improper use of our support services or make false reports of abuse and misconduct;

  9. that you do not engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data collection and extraction tools;

  10. that you do not impose an unnecessary burden on the Site or the networks or services associated with it, and that you are not the disruptor or instigator to do so;

  11. that you do not attempt to impersonate another User or person or use the Username of another User; that you do not sell or otherwise transfer your profile;

  12. not to use information obtained through the Site to intimidate, abuse or harm anyone else; that you will not use the Site as part of an effort to compete with us or even use the Site and / or its content for income-generating activities or for a commercial venture;

  13. not to decrypt, decompile, or reverse engineer any or all of the software behind the Site;

  14. that you do not attempt to circumvent any measures intended to prevent or restrict access to the Site or any part of it;

  15. that you do not insult, make feel inconvenience, intimidate or threaten our employees or agents who provide any part of the Site to you;

  16. that you do not destroy the notice of copyright or other proprietary rights to a text;

  17. that you do not copy or modify Site software, including, but not limited to: Flash, PHP, HTML, JavaScript, or any other code;

  18. that you do not upload or transfer (or attempt to do so): viruses, Trojans, or other material, including excessive capitalization and spam (repeated posting of the same text), all that interferes with any interrupted use and enjoyment of the Site by the parties, or that damages, affects, interrupts or interferes with the use, functions, operations, or maintenance of the Site;

  19. that you are not uploading or transferring (or attempting to do so): any material that functions as a passive or active information gathering or providing mechanism, including (but without limitation) clear graphic exchange formats (“gifs”), 1x1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms");

  20. except when it results from standard search engines or from use of Internet browsing, from the use, launch, development, or distribution of any automated system;

  21. that you do not engage in any of the following (but listed without limitation): spiders, robots, rogue utilities, scraper, or an offline reader accessing the Site and using or launching a non-automated script or other software;

  22. that, in our opinion, you do not belittle, harm, or otherwise harm us and / or the Site;

  23. that you are not using the Site in a way that is contrary to applicable laws and regulations.

5. CONTRIBUTIONS GENERATED BY THE USER

5.1. The Website may provide the User with the opportunity to create, submit, post, display, transfer, perform, publish, distribute or broadcast content and materials to us or on the site , including, but not limited to: text, writings, video, audio, photos, graphics, comments, suggestions, or personal information or other materials (collectively referred to as “Contributions”).

5.2. Contributions may be visible to other Users of the Website and by third-party Websites.

5.3. We accommodate Users who request their submission to be kept confidential and as their property. Users who create or make available any contributions will thereby propose and ensure that:

  1. the creation, distribution, transmission, public display or performance, access, downloading, or copying of their contributions does not infringe or infringe any proprietary rights, including but not limited to copyright, patent, trademark, trade secret, or moral rights of any third party;

  6. their contributions do not ridicule, mock, belittle, intimidate anyone;

  7. their contributions do not represent a violent overthrow of a government or cause, encourage or threaten anyone's physical or mental harm;

  8. their contributions do not violate any enforceable law, regulation or legal rule;

  9. their contributions do not violate any third-party's private or public rights;

  10. their contributions do not contain elements that solicit personal information from anyone under the age of 18 or who exploit persons under the age of 18 in a sexual or violent manner;

  11. their contributions do not violate child pornography laws or laws that otherwise protect the health and welfare of minors;

  12. their contributions do not contain offensive comments related to race, national origin, gender, sexual orientation, or any form of disability;

  13. their contributions do not otherwise infringe or be linked to any element that violates any provision of these Terms and Conditions or any enforceable law, regulation or legal rule.

5.4. Any use of the Website in violation of the foregoing is in violation of these Terms and Conditions and may result in, among other things, the termination or suspension of users' rights to use the site.

6. CONTRIBUTION LICENSE

6.1. By posting contributions to any part of the Site or linking them to social network accounts through the Site, you automatically consent, propose and warrant that you have the right to grant us an unlimited, absolute , unquestionably, persistent, non-exclusive, transferable, royalty-free, fully paid, worldwide right and license to host, use, copy, reproduce your contributions (including, without limitation, your image and voice), to make public, to sell, to resell, to publish, to broadcast, to re-title, to archive, to store, to redeem, to perform publicly, to display in public, otherwise to share (reformat), translate, transmit, summarize (in part or in full) and distribute, for any purpose, commercial, for advertisement, or otherwise, and to make derivative works of these contributions (or to prepare to make these), or to insert them into other work, and to assign and authorize licenses to all of the foregoing. This license will apply to any format, media, or technology now known and to be developed later, and includes the use of your name, company name, and franchise name, as applicable, and any trademark, service mark, trade name, logo, personal and commercial images that you provide. You waive all moral rights in your contributions, and you ensure that moral rights are not otherwise assigned to your contributions.

6.3. We do not assert ownership of your contributions. You retain all ownership in all of your contributions and any other intellectual property or other proprietary rights associated with your contributions. We are not responsible for your statements or representations in the contributions you make to any part of the Site.

6.4. You are fully responsible for your contributions to the Site and you expressly agree to exonerate us from any and all responsibility of any legal action against us in relation to your contributions.

6.5. As a result of an agreement that is sought with you before you publish contributions (and also after publishing, if necessary), we reserve the right to edit, redact, or change it in any other way.

6.6. After your contributions have been published on the Site, we have the right to recategorize them in more appropriate places on the Site.

6.7. We have an obligation to keep your contributions on the Site for at least ten years or, if less, for the life of the Site. It is expected that your contributions will remain on the Site for many more years than the ten-year timeframe.

6.8. You have the right to request that your contributions be removed from the Site at any time for any reason, within a reasonable deadline.
